Ansar Forces Act, 1995

Laws made for the formation of Ansar forces

  Whereas it is expedient and necessary to form the Ansar forces and to make provisions in connection therewith;

Therefore it is hereby enacted as follows:-


 

       

             

       

Short title

1 This Act may be called the Ansar Forces Act, 1995

       

  Definition:

2 Subject to anything contrary to the subject or context, in this Act,—


(a) “regulations” means regulations made under this Act;


(b) “Force” means the Ansar Force constituted under this Act;


(c) “rules” means rules made under this Act;


(d) “Director-General” means the Director-General appointed under section 4

            

  Formation of Ansar forces

3 (1) According to the provisions of this Act, a force called Ansar Force shall be constituted


(2) The force shall be a line force within the meaning of the definition of "line force" given in Article 152 of the Constitution of the People's Republic of Bangladesh.

                  

Supervision and management

4 The Force shall be under the overall supervision of the Government, and shall be under the direction of a Director-General appointed by the Government in accordance with the orders and instructions issued by the Government from time to time subject to these Acts and Rules and consistent therewith.

       

 

       

             

       

Officers, employees etc

5 All the officers and employees who are in the organizational structure approved by the government for the Directorate of Ansar shall be considered as the officers and employees of the force.

       

 

       

             

       

Classification of forces, etc

6 (1) The force shall consist of two classes of Ansar, namely:-


(a) General Ansar; And


(b) Affiliated Ansar


(2) Both classes of Ansar referred to in sub-section (1) shall be enrolled and joined respectively in the manner prescribed by the regulations and their allowances, clothing, training, etc. shall be prescribed by the regulations.


(3) The General Ansar shall be volunteers and in times of national calamity or crisis, if necessary, the Director General or any officer empowered by him for this purpose may call upon them to perform duty as volunteers.


(4) At the request of any organization or institution affiliated to Ansar, the Director General shall be appointed for a fixed period for the purpose of performing any security and law and order duties under the direction of any officer authorized by him for this purpose.

       

Army posts

7 Ansar forces shall have all or any of the following positions, namely:-


(a) Police Station Company Commander;


(b) Assistant Police Station Company Commander;


(c) Platoon Commander;


(d) Assistant Platoon Commander;


(e) Habildar;


(f) Naik;


(g) Lance Naik;


(h) Ansar

            

Formation of Ansar units

8 The Director General may, with the prior approval of the Government, establish one or more Ansar units of the force in each district and their formation, management and control shall be prescribed by regulations.


Explanation.- In this section unit means section, platoon, company and battalion.

       

Duty of Forces, etc

9 (1) The main responsibility of the force shall be-


(a) providing assistance to the Government or any authority under the Government in public security work and participating in any other security work;


(b) Participating in any public welfare work directed by the Government with a view to improving the socio-economic condition of the country.


(2) In particular, and without prejudice to the foregoing provisions, the Force shall, under the direction of the Government, render aid and assistance to the following forces, namely:-


(a) Ground Forces;


(b) Navy;


(c) Air Force;


(d) Bangladesh Rifles;


(e) the police force;


(f) Battalion Ansar

       

  Carrying arms and ammunition

10 The members of the armed forces may carry and use arms and ammunition subject to the policies and orders issued by the Government from time to time, and subject to such conditions as may be imposed.

            

Obligation to obey orders

11 (1) All members of the force shall be bound to obey the lawful orders given to them by the proper authority


(2) The provisions of the Police Act, 1861 (Act V of 1861) and the order made thereunder shall apply to affiliated Ansars.

           

delegation of power

12 The Director General may, by order in writing, delegate any of his powers or duties under this Act to any officer under him.

           

Power to make rules

13 The Government may, by notification in the Official Gazette, make rules to carry out the purposes of this Act.

            

Power to make regulations

14 For carrying out the purposes of this Act, the Director General may, with the prior approval of the Government and by notification in the Official Gazette, make such regulations as are not inconsistent with this Act or any rule.

Revocation and Custody

15 (1) The Ansars act, 1948 (E.P. Act VII of 1948) hereinafter referred to as the said Act, is hereby repealed.


(2) All immovable and immovable property, funds, liabilities and documents of the Ansar forces constituted under the said Act shall be the property, funds, liabilities and documents of the forces constituted under it with the introduction of this Act.


(3) All enlisted or unaffiliated Ansar employed or serving in the Ansar forces under the said Act immediately before the commencement of this Act shall be deemed to have been enlisted or unaffiliated under this Act.


(4) all rules and orders made under the said Act and in force on the date of the commencement of this Act;
